ara reserves the right to take any such action as it deems necessary in the event that it suspects any fraudulent or unlawful activity, including without limitation, terminating access to the Web Site, terminating any ara accounts and/or cancelling any order for products.

We reserve the right to terminate and/or deny you access to the Web Site if we determine, in our sole discretion, that you are violating these Terms of Use, or applicable law, rule, regulation or order or that your conduct is harmful to us, our interests or the interests of another user, a third-party provider, merchant, sponsor, licensor, service provider or any other third party.

Subject to the terms and conditions set forth in our Privacy Policy (linked at the bottom of each page in the Web Site), all User Communications will be treated as non-confidential and nonproprietary information. 6. Termination/Suspension

We may suspend or terminate your use of the Web Site at any time, for any reason or for no reason. We reserve the right to change, suspend, or discontinue all or any aspect of the Web Site at any time without notice. Additionally, we may cancel any order placed through the Web Site at any time in our sole discretion.

7. Purchasing Products; Returns

All products purchased from the Web Site are delivered pursuant to a shipment agreement. Accordingly, the risk of loss and title to such purchased products pass to you upon our delivery to a commercial carrier.

We attempt to describe our products as accurately as possible. However, we do not warrant that any product description or other content on the Web Site will be accurate, complete, reliable or error-free. If a product purchased on the Web Site does not conform to the product description, your sole and exclusive remedy is to return the unused product.

The price for any item purchased from the Web Site is not confirmed until your order is accepted by ara. Although we strive to make our Web Site pricing as accurate and up to date as possible, the price you receive at order acceptance may differ from the price displayed for the product on the Web Site.

When you shop with us, we want you to be completely satisfied. If you are not satisfied with a purchase made at the Web Site, you may return it for an exchange or refund of the purchase price you paid minus all shipping charges. We can only accept returns purchased through the Web Site. All purchases made through a department store or an ara store must be returned to the original place of purchase.

Just send your unused and unworn item to us within 60 days of shipment, along with a copy of your purchase receipt and a return authorization form (available here) to:

Based on your return instructions in the return authorization form, we will issue you a credit to your credit card or send the replacement item. We can only issue credit to the same credit card used for the purchase. If we believe that the product you've returned has been damaged or worn, we will send it back to you as soon as possible. Shipping and handling charges are not refundable. We do not take title to returned products until the item arrives at our returns department. Alternative returns policies may apply to particular products and product lines.

At ara-shoes.net, our commitment to our customers is to offer convenience, service and product availability online at competitive prices. We also offer merchandise at promotional prices.

We may offer merchandise on-line at the same price at which it is offered in stores, and our promotions may follow those that you'll find in stores. However, in some cases, the prices will be different because the website and stores may choose to offer items at different prices or may run different promotional events at different times. Additionally, ara-shoes.net may offer a product, price or promotion that is not available in the stores.

We display the original MSRP and when applicable the current, reduced purchase price on the ara-shoes.net website, this means that the merchandise was previously offered at the higher price listed. The strikethrough price is used to identify merchandise marked down from the original MSRP.

Strikethrough prices referenced on this website reflect original offering prices from the ara-shoes.net website or ARA's stores and are not necessarily the former price for the merchandise. Intermediate markdowns from the original MSRP price may have been taken.

Percentage reductions are off of original MSRP, except where noted.

ara warrants for a period of one year after purchase date that ara-branded products purchased from the Web Site are free from defects in manufacturing and materials. This is not a guarantee against normal wear and tear.

If, for any reason, a claim proceeds in court, rather than in arbitration, you and ara each waive any right to a jury trial. Notwithstanding any other provision in these Terms of Use, ara may commence suit in court to enjoin infringement or misappropriation of intellectual property rights or confidential information.

14. Remedies for Breach of these Terms by You

Without limiting any other rights or remedies, in the event that ara determines, in its sole discretion, that you have breached any portion of these Terms of Use, or have otherwise demonstrated conduct that ara deems to be inappropriate or unacceptable in its sole discretion, ara reserves the right to (i) warn you via e-mail that you have violated these Terms of Use; (ii) delete any content provided by you or your agent(s) to the Web Site; (iii) discontinue your access to the Web Site, (iv) notify and/or send content to and/or fully cooperate with law enforcement authorities for further action; and/or (v) any other action which ara deems to be appropriate.

If your ability to access and/or use the Web Site or any other service provided to you by ara is discontinued by us hereunder, then you agree that you shall not attempt to re-register with or access the Web Site, any other service provided by ara, through use of a different member name or otherwise.

You represent to ara that you have the authority to access and use the Web Site according to these Terms of Use. These Terms of Use and any Additional Terms (as such terms shall be identified when posted on the Web Site) constitute the entire understanding between the parties as to the subject matter here of, and supersede all prior agreements and understandings. You consent to receive communications from us electronically. We may communicate with you by email or by posting notice on this site. You agree that any notices, disclosures, amendments or other communications provided to you electronically satisfy any requirement, legal or otherwise, that such communication be in writing.

18. Bulk Purchase and No Resale Policy

ara does not permit bulk buying for purposes of resale. Although we would like to sell as many ara products as possible, we also want customers to benefit from ara’s footwear knowledge, experience, and service. ara’s reputation as one of the premier footwear brands in the world is based on superior service. On ara’s ecommerce site, we ensure you receive the right shoe for you in the right size. If your ara shoes don’t fit or you are otherwise unsatisfied and you purchased them at us.ara.com, you may return them by mail or to an authorized ara store in accordance with ara’s . Likewise, ara products purchased at ara-shoes.net are covered by ara’s  Products purchased from unauthorized resellers are not eligible for return or warranty coverage.

To be clear, if you purchase a pair of ara shoes for personal use and decide to resell them later, that is permissible. Likewise, under certain circumstances, we may permit bulk purchases for promotional proposes or specific events. As a general matter, however, purchasing in bulk solely for purposes of resale is prohibited.

You may purchase no more than ten separate ara products in any one order. If you require more than ten products for personal use or gifts, you may place more than one order. However, repeated purchases amounting to more than ten products may be scrutinized to ensure they are not intended for resale. Orders determined to be for resale may be rejected.

19. Warranty

ARA LIMITED WARRANTY INFORMATION

ara’s One-Year Limited Warranty applies solely to ara products purchased at our website, ara-shoes.net.com, or from authorized ara shoes, Inc. retailers. The One-Year Limited Warranty is void if purchased from an unauthorized dealer. Some defects such as deteriorating soles go beyond the One-Year Limited Warranty. ara reserves the right to inspect any shoe for determination of warranty coverage. ARA DOES NOT OFFER REPAIRS OR REFURBISHMENT.

ara’s One-Year Limited Warranty Covers the Following:

  • Stitching
  • All hardware – eyelets, hooks, buckles and ornaments
  • Quality of leather – inconsistencies resulting in premature wear patterns
  • GORE-TEX guaranteed to be waterproof for the lifespan of the product
  • Attachment of soles to upper and of components of soles to one another
  • Durability of outsole – will not deteriorate, crack, or split under normal wearing conditions

The Following are NOT Covered under ara’s One-Year Limited Warranty:

  • Material failure caused by excessive wear, unreasonable use, exposure to caustic chemicals, extreme heat, alterations, or abnormal wear related to occupation
  • Any alterations such as heel taps or resoling
  • Stitching or hardware failure due to being caught, hooked, snagged or other abnormal wearing accidents
  • Leather not properly treated to keep from drying out
  • GORE-TEX failure due to complete submersion in water or allowing the water to seep over the top of the footwear
  • Separation of soles or sole components due to being caught, hooked, snagged or cut
  • Normal wear on soles or heels due to individual wear patterns, or heavy wear associated with occupation
  • Poor fit

ara Return and Inspection Process:
ara reserves the right to inspect any shoe for determination for warranty coverage. After inspection, if the shoes are deemed defective, they become the property of ara and you will receive a credit voucher. A credit voucher may not be combined with any other discounts or promotions. If it is determined that the shoes are not covered under the Limited Warranty, your shoes will be returned to you. All ara warranty decisions are final.

  • Allow 3 to 4 weeks for the warranty inspection process
  • Shoes returned for warranty inspection must be in good condition and cared for properly as outlined in the “Shoe Care” section on our website
  • Continue to the next page to start your warranty claim
  • Once you complete this process, you will receive a warranty claim number. Be sure to retain this to track your claim.
